Egemenlik kavramı, antik Yunandan günümüze tartışılan bir kavramdır. Ulus egemenliği, halkın egemenliği, devlet egemenliği, toprak egemenliği gibi birçok alanda kendisine yer bulan bu kavram, farklı düşünürler ve farklı disiplinler tarafından farklı yönleriyle ele alınmıştır. Son dönemde uluslararası siyasal sistemin yapısı, uluslararası hukuk ve uluslararası örgütlerdeki gelişmeler, egemenlik kavramının tartışılmasında farklı noktalara dikkati çekmektedir. Günümüzdeki gelişmeler neticesinde, eskinin mutlak yönetimleri ve yönetim anlayışlarının günümüzde eskisi kadar ‘mutlak’ olmadığı aşikardır. Dünyadaki tüm devlet ve yönetimler, ister istemez birtakım kurum ve kurallarla sınırlanmaktadır. Bunun akabinde ortaya çıkan uluslararası örgütlerin ve hukuk kurallarının, egemenliğe ne derece müdahalesinin olduğu ve devletlerin egemenliğini sınırlandırıp-sınırlandırmadığı tartışması sürekli olarak gündemdedir. Birleşmiş Milletler Örgütü de gerek global yapısı, gerekse etkinliği sebebiyle kurulma aşamasından itibaren bu tartışmanın içerisinde olmuştur. Devletlerin egemenliklerine verdikleri önem ve bundan taviz vermek istememeleri, bu tür örgütlere üyelikte çekingen davranmaları ile sonuçlanmıştır. I. Dünya Savaşı sonucu ortaya çıkan Milletler Cemiyeti ve II. Dünya Savaşı sonucunda ortaya çıkan Birleşmiş Milletler, hem kuruluş Şartlarında hem de farklı organ ve kararlarında net ifadelerle egemenlik hakkında açıklamalar yapmışlardır. İki büyük savaş sonucunda, birçok yeni devletin ortaya çıktığı ve siyasal sistemdeki devletlerin sayısının arttığı düşünülürse, yeni ortaya çıkan devletlerin kaygısının giderilmesi oldukça önemlidir. Bu sebeple, dış ilişkilerde bağımsızlık olarak da açıklanabilecek devletlerin egemenliğinin, Birleşmiş Milletler Şartı ve kararlarında nasıl açıklandığı, hangi noktalar önem verildiği oldukça önemli bir hal almaktadır. Bu çalışmada, egemenlik kavramı tarihsel süreçte açıklanarak, Birleşmiş Milletler Örgütünün, kavrama nasıl baktığı kurallar ve kararları kapsamında açıklanmaya çalışılacaktır.

The concept of sovereignty is a controversial concept that is being discussed daily from ancient Greece. This concept, which is found in many fields such as nation domination, people's sovereignty, state sovereignty and territorial sovereignty, is handled differently by different thinkers and different disciplines. In recent years, the structure of the international political system, developments in international law and international organizations, draws attention to the different points in discussing the concept of sovereignty. As a result of today's developments, the absolute management of the escape and the understanding of the management are not as 'absolute' as the present day. All the governments and governments in the world are restricted by unwilling institutions. It is constantly on the agenda that the emerging international organizations and the rule of law, the extent to which it interferes with sovereignty, and whether it limits the sovereignty of states. The United Nations Organization has been involved in this debate from the time of its establishment, due to its global structure and its effectiveness. The importance given to the sovereignty of States and their desire to make concessions has resulted in their being shy of membership in such organizations. After the end of the First World War, the League of Nations and II. The United Nations, which emerged as a result of World War II, made clear statements about sovereignty both in the Foundation Terms and in its different bodies and decisions. As a result of two major wars, it is very important to eliminate the worry of emerging states if many new states are emerging and the number of states in the political system is thought to increase. For this reason, it is very important how the sovereignty of the states, which can be described as independence in external relations, is explained in the United Nations Charter and its decisions and in which points are emphasized. In this work, the notion of sovereignty will be explained in the historical process and will be tried to be explained within the context of the rules and decisions of the United Nations Organization.
