Başkanlık sistemi kuvvetlerin sert ayrımına dayanan demokratik bir hükümet rejimidir. Uygulamaları açısından temel özelliği yürütme gücünün monist bir yapıda devlet başkanının elinde olması ve halkın güvenine dayanmasıdır. Başkanlık sisteminin en bilinen örneği Amerika Birleşik Devletleri’nde uygulanan sistem olmakla birlikte, sistemin uygulama farklılıkları ile birlikte incelenmesi daha iyi anlaşılması açısından önem arz etmektedir. Dolayısıyla, ABD’de ve Türkiye’de başkanlık sisteminin mukayeseli ele alındığı bu çalışmada, başkanlık sistemi uygulama farklılıkları üzerinden değerlendirilmiştir. ABD Anayasasının öngördüğü bir sistem olan başkanlık sistemi doktrin haline getirilerek uygulamaya koyulmuş, daha sonra ise dünyanın birçok farklı bölge ve ülkesinde uygulama şansı bulmuştur. Türkiye’de 2017 yılında yapılan değişiklikle Türk tipi parlamenter sistemin ortaya çıkardığı siyasi krizleri aşmak için Cumhurbaşkanlığı Hükümet Sistemine geçilmiştir. Türkiye’de benimsenen yeni sistem ABD başkanlık sisteminden bazı noktalarda farklılık göstermektedir. Bu farklılıklar Türkiye’ye özgü sosyal, siyasal ve kültürel özelliklerden kaynaklanmaktadır. Cumhurbaşkanlığı hükümet sistemi rasyonelleşmiş bir hükümet sistemi arayışından ortaya çıkmış olup anayasal organların seçimleri, yürütme organının görevleri ve yargılanma usulleri, bütçe kanunun onaylanması ve Cumhurbaşkanının kararnameleri gibi konularda yeni bir anayasa tasarımı ortaya koyarak kendine has bir sistem öngörmüştür. Tarihsel ve betimsel bir metodolojinin kullanıldığı bu çalışmanın temel amacı; ABD ve Türkiye’de uygulanan başkanlık sistemlerinin karşılaştırılmasını yaparak benzeyen ve farklılık arz eden yönlerini ortaya koymaya çalışmaktır.

The presidential system is a democratic government regime based on the principle of strict separation of powers. The main feature of the system is incumbent on president of executive power on monist structure and is based on public trust. Although the best-known example of the presidential system is the USA, it is important to understand the system together with its implementation differences. Thus, in this study, which compares the presidential systems in the United States and Turkey, the presidential system has been discussed in terms of implementation differences for each country. The presidential system, a system set forth by the US Constitution has been implemented which was converted into a doctrine, and then has been applied in many different regions and countries of the world. As a result of the change in 2017, the Presidential government system was introduced to overcome the political crises of the Turkish parliamentary system. The new political system in Turkey differs from the US in certain aspects. These differences are due to social, political and cultural characteristics that are unique to Turkey. The presidential government system emerged from the search for a rational government system, and it proposed a unique system by introducing a new constitutional design issue such as elections of executive, legislative and judicial powers, tasks and trial procedure of executive power, approval of the bill and budget allocations as well as a presidential decree. The main purpose of this study, which uses a historical and descriptive methodology, is to put forward the similarities and differences between the presidential systems in Turkey and the US by comparing them.
