Yerel halkın mahalli müşterek ihtiyaçlarını karşılamak için oluşturulan, kendilerine ait bütçesi olan, karar organları seçimle işbaşına gelmiş kamu tüzel kişiliklerine yerel yönetim denir.  Bu yerel idareler gündelik hayatta insanın en çok ihtiyaç duyduğu hizmetleri icra etmektedir. Bu yönetimler ile ilgili tarihsel süreçte birçok yasal düzenlemeler yapılmıştır. En son 2012 yılında 6360 sayılı yasa ile bir düzenleme gerçekleşmiştir. Bu 6360 Sayılı Yasa ile Hatay ili büyükşehir statüsünü kazanmıştır. Bu çalışmada Hatay ilinin Payas ilçe belediyesi meclis üyelerinin 6360 sayılı düzenlemeye ilişkin algılarını, büyükşehir belediyesi ile ilçe belediyeleri arasında yaşanan sorunları, muhtemel sorunların nedenlerini ve meclis üyeleri ile yapılan derinlemesine mülakat sonuçlarını analiz etmektedir. 6360 sayılı Yasa ile büyükşehir belediyesi statüsüne kavuşan Hatay büyükşehir ve yasa öncesi belde belediyesi olduğu halde bugün ilçe statüsüne kavuşan Payas ilçe belediyesi arasındaki ilişkinin ilçe meclis üyeleri tarafından nasıl değerlendirildiğinin incelenmeye değer olduğu düşünülmüştür. Çalışmada öncelikle Türkiye’deki büyükşehir yönetim modelleri ile ilgili genel bir değerlendirme yapıldıktan sonra, yapılan görüşmelerin sonuçları tartışılmış ve tespit edilen sorunları gidermeye yönelik olarak çözüm önerileri sunulmuştur. Temel sorunlar, sunulan hizmetler, yetki paylaşımı ve kaynak sorunu bağlamında önermeler yapılmıştır. Payas ölçeğinde yapılan bu çalışmada belirlenen mevcut sorunlar, bu konuda daha önce yapılan çalışmalarla benzer sonuçlar ortaya koymuştur. Genel bir değerlendirme ile çalışma sonlandırılmıştır. Bu çalışma için, Hatay Mustafa Kemal Üniversitesi, Sosyal ve Beşeri Bilimler Bilimsel Araştırma ve Yayın Etiği Kurulu’ nun, 06.11.2020 tarih ve 02 sayılı kararı sunulmuştur.

The public legal entities created to meet the common needs of the local people, have their own budget, and whose decision-making bodies are elected are called local government. These local administrations perform the services that people need most in daily life. Many legal regulations were made in the historical process regarding these administrations. An arrangement was made with the law numbered 6360 in 2012. With this Law No. 6360, Hatay has gained metropolitan status. In this study, the perceptions of the councilors of Payas district municipality of Hatay regarding the regulation numbered 6360, the problems between the metropolitan municipality and the district municipalities, the reasons for possible problems and the results of in-depth interviews with the council members. It is considered worth examining how the relationship between Hatay metropolitan municipality, which gained the status of a metropolitan municipality with Law No. 6360, and Payas district municipality, which gained the status of a district before the law, was evaluated by the district council members. After a general evaluation study, primarily related to metropolitan governance model in Turkey, the results of interviews solutions aimed at addressing the problems identified were presented and discussed. Proposals were made in the context of basic problems, services provided, authority sharing and resource problems. The current problems identified with this study conducted on the Payas scale revealed similar results to previous studies on this subject. The study has been terminated with a general evaluation. For this study, Hatay Mustafa Kemal Üniversity Social and Humanities Research and Publishing Ethics Board’s decision dated 06.11.2020 and numbered 02 has been submitted.
